Dallas Drunk Driving Lawyer – Questions

If convicted of DWI will a person have to go to jail?

Generally the answer is no. For a first offense DWI, even though jail time is possible, a person will normally get probation. However, they may elect to do jail time instead if they prefer. For a second DWI offense, depending on the length of time since the previous DWI, if the person is convicted and placed on probation there may be a minimum jail sentence from 3-5 days as a condition of probation.
