How long will an individual’s license be suspended after being charged with DWI?
The length of the suspension will depend on whether the individual decided to give a breath or blood test, and on whether it was a first or second offense. For a first offense and refusal to take an alcohol test, there is an automatic suspension of 180 days. If the person gives a sample and fails the automatic suspension for a first offense is 90 days. For a second offense: refusal to give a sample is a 2 year suspension. If a sample was given and was more than .08 the suspension will be for 1 year.
