What is the difference in Texas between DWI and DUI?
In Texas, the main difference is age. Minors under the age of 21(legal drinking age), are generally given DUI’s and adults are given DWI’s. Under a DUI the officer only needs a “detectable amount of alcohol,” a very low burden for the officer, but with a DWI, the officer needs probable cause. However, the arresting officer has the option of giving a DWI to the minor instead of a DUI. It is completely at the officer’s discretion.
