What does “intoxicated” mean?

In Texas, “intoxicated” is defined by the DWI statute in two ways. The first is that a person is intoxicated when he or she via the ingestion, etc. of an alcoholic beverage, drug, or controlled substance has lost the normal use of either their mental or physical faculties. The second way of defining intoxicated is an individual that drives with a blood alcohol concentration level of .08 or more.
