Arrest Protocol

In any crime, there is a certain protocol that must be followed by the arresting officers in order for everything to go well. If an officer does not follow all of the steps correctly, the arrest and any conviction can get thrown out.

One of the most important things for the police to do when arresting a person is to make sure that they are aware of all of their rights. According to the Supreme Court, the police must read a person his or her Miranda rights. Without ensuring that a person is aware of his or her rights before speaking, any admissions made are usually not allowed since the person was not made aware of his or her rights prior to speaking to police.

In addition to ensuring that a person is aware of his or her rights before the arrest is fully made, the police must also ensure that everything is recorded properly. In a DWI case, it includes recording any failed sobriety tests and also making sure that the test results for a breathalyzer are recorded properly as well.

It is not unheard of for an entire case to be thrown out because the police did not follow the correct protocol during the arrest. Any arrest that is made must follow the protocol or risk being thrown out completely.
