DWI Under 0.08 BAC

Some people might think that having a BAC under 0.08 will get them off the hook for DWI. This, however, is not the case. In order to charge you with a DWI, the police must prove that you either lost the normal use of you mental faculties, lost the normal use of your physical faculties, or had a BAC of 0.08 or higher.

Unfortunately, “normal” is a very flexible term. This means that if you do not have a very good lawyer, it may be very easy to prove that you were outside of your normal faculties. With a good lawyer on your side, however, proving that you were not normal can be very difficult. Due to the nature of the term “normal” and how it applies to the general public, it is up to you and your attorney to define what is normal for you.

This also means that if you have a BAC that is within the legal limit, you can still be charged with a DWI. This is up to the discretion of the arresting officer. If he or she believes that you are not operating within your normal faculties, you can be arrested no matter what your BAC is. Because the officer bases what is normal off of his or her own experience, it can be easy to arrest you for DWI.
