Penalties for First Time DWI

The legal consequences of a first time DWI conviction vary from state to state. In Texas, the penalties are quite strict, and include:

  • License suspension of 90 days for individuals who submit to a chemical test. Persons who refuse the test face at least a 180 day license suspension.
  • A fine of up to $2,000 if no one is hurt as a result of the DWI. If another person sustains serious physical injury or death, the fine can increase to $10,000.
  • A jail sentence of 72 hours to 180 days. 2-10 years in jail for serious physical injury to another. For death to another, 2-20 years of jail time.
  • On average, a probationary period of 1 to 2 years.
