Driver ‘s License Hearings

When a driver is stopped for suspected DWI in Dallas, the general procedure is for the police officer to administer certain field sobriety tests. If the driver fails those tests, he or she is taken to a police station and asked to submit to a breathalyzer or blood test. If the driver ‘s blood alcohol content (BAC) is over .08, or if the driver refuses to submit to a test, his or her license is taken away on the spot.

If this has happened to you, you have fifteen days to request a driver ‘s license hearing. If you do not request a hearing, the suspension of your driver ‘s license will automatically go into affect forty days after your initial arrest. For a first-time DWI, this suspension can last up to 180 days. For a second-time DUI, it can last up to 2 years.

Hearing Procedures

If your license has been suspended, you are probably curious about what to expect when you attend the hearing to get your license back. Here is some general information:

The hearing will probably be held in the county in which you were arrested. If this is not feasible, the plaintiff can make arrangements with your Dallas DWI defense attorney to conduct the hearing through teleconference.

The plaintiff will be a representative from the Department of Public Safety. The defendant will, of course, be you and your Dallas DWI defense attorney. You will both be making argument to an Administrative Law Judge employed by the State Office of Administrative Hearings. The plaintiff ‘s job is to prove beyond a reasonable doubt that you were driving with a BAC of .08 or higher, and that the officer had reasonable cause to pull your car over.

If you win your case, your driver ‘s license will not be suspended. However, criminal penalties such as fines or jail time may still apply. Your Dallas DWI lawyer will be able to help you with both your driver ‘s license hearing and your criminal charges.
