What is a portable breath test device and what are the consequences of refusing the test?

A portable breath test device, or PBT, is an electronic alcohol breath tester. It is about the size of a cigarette package. These devices are not approved by the Texas Department of Public Safety for use either in criminal prosecutions or in administrative license suspension or revocation proceedings. Since there is no “implied consent” for compelling a person to submit to a PBT, there is no driver’s license suspension if a person refuses to take a PBT.
