There reaches a certain point in anyone ‘s evening out where they reach a level of intoxication that is dangerous to their health or to the health of another person. When this level is reached and noticed by the police, they are allowed to hand out a charge of public intoxication.

While many people believe that it is only possible to receive the charge after drinking, public intoxication can apply to both alcohol and drugs. The drugs responsible for public intoxication include prescription medicines, over-the-counter medications, and even aerosol sprays.

The police make sure that the individual who is intoxicated meets a variety of qualifications before arresting the individual. The qualifications include being intoxicated to the point of vulnerability to robbery and or assault; being intoxicated to the degree that attempting to drive home could have negative repercussions; falling over drunk; starting a fight; or throwing things. Falling over drunk is a problem as it puts an individual at risk of falling into the road and being hit by a car.

When an individual is given a ticket for public intoxication, that person can expect to spend 6 hours in jail. There is the option of being released to the custody of an adult who assumes responsibility for any of the ticketed individual ‘s actions that night.

Public intoxication is a Class C misdemeanor with a fine of up to $500. When the person is under 21, the punishment terms are equivalent to those of Possession of Alcohol by a Minor (MIP).
